What is the visitor's tax? On what basis is it levied?
Article 19 describes the rate of the visitor's tax.
This also means that the rate of the visitor's tax cannot be arbitrarily determined. Neither the municipality nor the tourist office can disregard the legal requirements.

Art. 19 Rate
1 The rate of the visitor's tax shall take into account the facilities of the holiday resort, the type of accommodation and the geographical location of the accommodation. It may vary according to the season.
2 The visitor's tax rate shall be calculated on the basis of the costs incurred for the services for which this revenue may be used in accordance with Article 22.

What is the visitor's tax used for?
Article 22 describes in detail how the visitor's tax revenue is to be used. Article 22 reads in detail as follows:

Art. 22 Use
1 The visitor's tax revenue shall be used in the interests of the persons subject to it.
2 It shall be used in particular to finance:
a) the operation of an information and reservation service;
b) local animation;
c) the construction and operation of facilities that serve tourism, culture and sport.

It is thus clear that the visitor's tax may not be used in any way. The municipal council is responsible for ensuring that this article is implemented.
